1. Introduction

Welcome to Haute Couture Cosmetics (“HCC”). By accessing or using our website (www.hccosmetics.co.za), you confirm that you understand and agree to be bound by these Terms and Conditions.

HCC operates within the Republic of South Africa and complies with:

  • Consumer Protection Act 68 of 2008 (CPA)

  • Electronic Communications and Transactions Act

  • POPIA (Protection of Personal Information Act)

If you disagree with these Terms, please stop using the website immediately.

2. Use of Website

All content on this site — including text, product descriptions, images, branding, and layout — is the property of HCC and protected under South African and international copyright law.

You may not:

  • Republish, duplicate, or exploit content for commercial use without written approval

  • Use data extraction tools (scrapers, bots, etc.)

  • Misrepresent our products or brand

Legal action may be taken for misuse.

3. Product Accuracy and Authenticity

We commit to providing accurate product descriptions and images.
However, packaging or design may differ due to:

  • International packaging variations

  • Batch code differences

  • Supplier or distribution version updates

These differences do not affect the authenticity or quality of the fragrance.

4. Pricing, Payments & Security

All payments are processed securely via third-party payment gateways:

  • PayFast (PCI-DSS Level 1 security encryption

  • Mobicred

HCC does not store or have access to banking or card details.

Orders are only released once payment is cleared.

5. Shipping & Delivery

We offer FREE shipping services  to your door.

Customers must ensure that:

  • The delivery address is correct

  • The customer or authorized receiver is available

  • Kindly note a delivery fee might apply in cases where incorrect delivery information was given, or through failed delivery attempts.

6. Returns, Refunds & CPA Rights

HCC complies with the Consumer Protection Act 68 of 2008.

6.1 Seven-Day Cooling-Off (CPA Section 20)

When purchasing online, you may return your order within 7 days of delivery if:

  • The customer notifies HCC in writing within seven days of delivery

  • The fragrance is opened only for inspection and minimally tested.

If the product has been opened to inspect or test, HCC may:

  • Accept the return after inspection,

  • Apply a partial refund, based on usage and diminished value

Shipping may be deducted when a return is not due to fault of HCC.

6.2 Six-Month Quality Warranty (CPA Section 56)

Within 6 months, you may return a product if:

  • It is defective, damaged, or not performing as expected

HCC may, at its discretion, offer:

  •  Full, or partial refund if the item shows signs of use

Exclusions:

  • Damage caused by misuse, improper storage, or negligence

All returns require authorization.

7. Our Products

  • HCC sells parallel imports sourced internationally. All products are covered by our own warranty, and any valid return will be honoured directly by HCC.

Every fragrance sold by HCC is traceable via batch number for authenticity verification

8. Limitation of Liability

By purchasing from HCC, you agree that:

  • Use of products is at your own risk

  • HCC is not liable for allergic reactions or personal sensitivity to ingredients

Always test fragrances on a small skin area.

HCC’s total liability will never exceed the product purchase price.

9. Electronic Communication

By interacting with HCC through website forms, checkout, or email, you consent to receiving communication electronically.

10. Customer Responsibility

You agree to:

  • Provide accurate personal and delivery information

  • Ensure secure and safe acceptance of the parcel upon delivery

  • Be 18 years or older when placing an order
